1. General

These Terms of Service ("Terms") govern your use of codedrive.store ("the Website") and any purchases made through it. By accessing the Website or placing an order, you agree to be bound by these Terms.

The Website is operated by CodeDrive, based in Seville, Spain.

2. Products and Descriptions

We make every effort to ensure product descriptions, images and compatibility information are accurate. However, we do not warrant that product descriptions or other content on the Website are complete, reliable, current or error-free.

3. Pricing and Payment

All prices are displayed in Euros (EUR) and include applicable taxes for EU customers. We reserve the right to modify prices at any time without prior notice. The price applicable to your order is the price displayed at the time of purchase.

Payment is processed securely through Shopify Payments, PayPal or Klarna. We do not store credit card information.

4. Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

5. Limitation of Liability

To the fullest extent permitted by applicable law:

CodeDrive sells OBD2 diagnostic hardware. The adapter is a general-purpose Bluetooth communication device that connects to the vehicle's OBD2 port.

CodeDrive is not responsible for:

  • Any modifications made to your vehicle's software, ECU parameters or electronic systems using third-party applications (including but not limited to BimmerCode, BimmerLink or any other OBD2 software)
  • Any damage, malfunction, loss of warranty, electrical issues or any other consequence resulting from coding, modifying or altering your vehicle's settings
  • The functionality, accuracy, reliability or safety of third-party applications used with our hardware
  • Any loss of data, vehicle functionality or performance resulting from the use of our products
  • Compatibility issues arising from vehicle software updates, regional variations or specific equipment configurations
  • Any indirect, incidental, special, consequential or punitive damages arising from the use of our products

The user assumes full responsibility for any and all modifications made to their vehicle. Coding and modifying vehicle parameters is performed entirely at the user's own risk. We strongly recommend creating backups before making any changes and consulting a qualified professional if in doubt.

Our total liability for any claim arising from or related to our products shall not exceed the purchase price of the product.

6. Third-Party Applications

CodeDrive is not affiliated with, endorsed by, or connected to BMW AG, MINI, Toyota Motor Corporation, SG Software GmbH & Co. KG (BimmerCode/BimmerLink) or any vehicle manufacturer. All trademarks are the property of their respective owners.

We do not develop, maintain or support BimmerCode or any other third-party application. Questions about app functionality, coding options or software behaviour should be directed to the respective app developer.

7. Intellectual Property

All content on the Website, including but not limited to text, images, guides, logos and design, is the property of CodeDrive and protected by applicable intellectual property laws. You may not reproduce, distribute or use any content without our prior written consent, except for personal use of purchased guides.

8. Warranty Disclaimer

Our products are sold "as is" to the extent permitted by law. While we test and verify our products, we make no representations or warranties of any kind, express or implied, regarding the suitability of our products for any particular purpose beyond their function as OBD2 Bluetooth communication devices.

This does not affect your statutory rights as a consumer under EU law, including the legal guarantee of conformity (2 years).

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Seville, Spain, without prejudice to your rights as a consumer to bring proceedings in your country of residence.

10. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
